• The Company does not guarantee the availability or accuracy of promotions and discounts provided by third-party businesses or advertisers.

2.1.3 Coupons

The Coupons module of our Service offers coupons and deals. Users acknowledge and agree to the following additional terms specific to the Coupons module:

• Coupons and deals are subject to expiration dates and may have usage restrictions.
• Users are responsible for ensuring that coupons and deals are valid and can be redeemed at the participating businesses.
• The Company is not responsible for the acceptance or rejection of coupons or deals by third-party businesses.

2.1.4 Social Media

The Social Media module of our Service enables social networking features. Users acknowledge and agree to the following additional terms specific to the Social Media module:

• Users are responsible for their interactions and content shared within the social networking features.

• The Company does not endorse or verify the accuracy of user-generated content within the module.

2.1.5 Dating

The Dating module of our Service facilitates online dating. Users acknowledge and agree to the following additional terms specific to the Dating module:

• Users must be of legal dating age in their jurisdiction to use this module.
• The Company does not perform background checks on users, and users are responsible for their interactions and safety when using the Dating module.
• The Company does not guarantee successful matches or relationships through the module.

2.1.6 Marketplace

The Marketplace module of our Service allows users to buy and sell products. Users acknowledge and agree to the following additional terms specific to the Marketplace module:

• Users are responsible for the accuracy and legality of product listings.
• The Company is not involved in transactions between buyers and sellers and does not guarantee the quality or condition of products.
• Users should review and adhere to our Marketplace Guidelines [link to Marketplace Guidelines] when using this module.

2.2 Each module connects to a corresponding webService via API, sharing data in real time. Users of our app can access data from these modules on the webServices.

3. User Data and Privacy

3.1 We may collect and process user data as described in our Privacy Policy. By using our Service, you consent to the collection and processing of your data as outlined in the Privacy Policy.

3.2 Our Blocked User Proximity Alert (BUPA) feature allows users to receive alerts when blocked individuals come within 500 feet of them. Use of this feature is subject to additional terms and privacy considerations, as outlined in the BUPA section of our Privacy Policy.

4. Payment and Ownership

4.1 Users may subscribe to our Service on a monthly payment basis. Ownership of the app remains with the Company until the app is paid off in full, but users are granted access to the app during the payment period.

5. User Content and Streaming

5.1 The Service or App may offer opportunities for you to engage in chat, blogs, message boards, online forums, and other features. It may also allow you to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Service. This content, which may include text, writings, video, audio, photographs, graphics, comments, suggestions, or material containing personal information, is collectively referred to as “Contributions.”

5.2 It’s important to note that other users of the Service and third-party Services may have access to view your Contributions. Therefore, any Contributions you submit should be considered non-confidential and non-proprietary. When you generate Contributions or make them available, you confirm and warrant the following:

1. Your Contributions, including their creation, distribution, transmission, public display or performance, as well as accessing, downloading, or copying them, do not and will not infringe upon the intellectual property rights of any third party, including but not limited to copyright, patent, trademark, trade secret, or moral rights.
2. You either own your Contributions as the creator and rightful owner, or you possess the necessary licenses, rights, consents, releases, and permissions to use and grant us, the Service, and other Service users the authority to use your Contributions in ways allowed by the Service and these Terms of Service.
3. You have obtained written consent, release, and/or authorization from every identifiable individual featured in your Contributions to permit their inclusion and use as permitted by the Service and these Terms of Service.
4. Your Contributions are accurate and truthful.
5. Your Contributions are not unsolicited or unlawful forms of advertising, promotional materials, pyramid schemes, chain letters, spam, or mass mailings.
6. Your Contributions must not contain any obscene, lewd, lascivious, vulgar, violent, harassing, libelous, or otherwise inappropriate content, as determined by us.
7. Your Contributions do not ridicule, degrade, intimidate, or abuse any individual.
8. Your Contributions do not advocate for the violent overthrow of any government or incite, encourage, or threaten physical harm against another person.
9. Your Contributions comply with all applicable laws, rules, and regulations.
10. Your Contributions do not breach the privacy or publicity rights of any third party.
11. Your Contributions do not include any content that solicits personal information from individuals under the age of 18 or exploits minors in a sexual or violent manner.
12. Your Contributions do not violate any federal or state laws prohibiting child pornography or any laws aimed at safeguarding the well-being of minors.
13. Your Contributions do not contain offensive comments related to race, nationality, gender, sexual orientation, or physical disabilities.
14. Your Contributions do not otherwise contravene any part of these Terms of Service or any relevant laws or regulations, nor do they link to content that does.

Any use of the Service that violates the above guidelines may result in the termination or suspension of your rights to use the Service.

6. Blocked User Proximity Alert (BUPA) Feature

Our Service includes a Blocked User Proximity Alert (BUPA) feature, designed to enhance user safety and privacy. BUPA allows users to receive notifications when someone they have blocked comes within 500 feet of them, providing users with information, location details, and options for emergency assistance.

Users are solely responsible for the use of the BUPA feature, including configuring their settings and selecting blocked users.

Users must ensure the accuracy of their location settings for the BUPA feature to function effectively.

The Company respects user privacy and takes measures to protect user data. The BUPA feature collects and processes location data, including proximity information.

Location data collected by the BUPA feature is used exclusively for the purpose of providing proximity alerts and emergency assistance options. The Company will not share location data with third parties unless required by law or as specified in our Privacy Policy.

Users have the option to configure the BUPA feature to share location data with emergency services (e.g., 911) in the event of an emergency. Users should exercise caution and use this feature responsibly.

The BUPA feature includes an emergency assistance option, which, when activated, provides users with the ability to contact emergency services (e.g., 911) and share their location details in cases of perceived danger or emergencies.

To activate the emergency assistance option, users must hold down the fingerprint button for a specified duration (e.g., 6 seconds) with the correct fingerprint or enter a designated pin number.

Users should use the emergency assistance option only in genuine emergency situations and understand that misuse may result in legal consequences.

The Company employs industry-standard security measures to protect user data, including location data collected through the BUPA feature. However, users should be aware that no system can be entirely immune to potential breaches.

Users are encouraged to maintain the security of their devices, including fingerprint or pin protection, to prevent unauthorized access to the BUPA feature and associated data.

The development and implementation of the BUPA feature may be part of a larger project, and the Company prioritizes delivering a secure and effective feature over speed.

The Company will make reasonable efforts to ensure the BUPA feature is developed, tested, and deployed accurately and in compliance with applicable laws and regulations.

Users will be informed of any updates or changes to the BUPA feature as they become available.

7. Apple and Android Devices 

When you utilize the Service via a mobile application obtained from either the Apple Store or Google Play (referred to as an “App Distributor”), the following stipulations apply:

1. The license granted to you for our mobile app is limited to a non-transferable right to use it on a device operating either the Apple iOS or Android operating systems, as applicable, and in accordance with the usage guidelines delineated in the terms of service provided by the relevant App Distributor.
2. You acknowledge that each App Distributor bears no responsibility for furnishing maintenance and support services for the mobile application. Instead, we are responsible for providing any such services as detailed in the terms and conditions of this mobile application license within these Terms of Use or as mandated by applicable law.
3. Should the mobile application fail to meet any applicable warranty, you may contact the pertinent app distributor. Per their terms and policies, the distributor may refund any payment made for the acquisition of the mobile application. However, in accordance with applicable law, the relevant app distributor will have no further warranty obligations concerning the mobile application.
4. You confirm and guarantee that you are not residing in a nation under U.S. embargo or one designated as “terrorist supporting” by the government. Additionally, your name is not included on any government-restricted or prohibited individuals or entities list.
5. While utilizing the mobile application, you must adhere to any relevant third-party agreements. For example, if you use a VoIP application, you must not breach their wireless data service agreement.
6. You acknowledge and consent to the fact that the App Distributors are considered third-party beneficiaries of the terms and conditions outlined in this mobile application license within these Terms of Use. Consequently, you acknowledge and agree that each App Distributor possesses the right (and will be regarded as having accepted this right) to enforce the terms and conditions contained in this mobile application license within these Terms of Use against you.
7. Liability and Disclaimers

8.1 The content presented on this webService is provided with no assurances, conditions, or guarantees regarding its accuracy. Unless explicitly mentioned otherwise, to the maximum extent allowed by law, Best Dating App Ever and its suppliers, content providers, and advertisers explicitly disclaim all implied conditions, warranties, and other terms that might otherwise be inferred by statute, common law, or equity. They shall not be held responsible for any form of damages, including but not limited to direct, indirect, special, consequential, punitive, or incidental damages, as well as damages for the loss of use, profits, data, or other intangible assets, harm to goodwill or reputation, or the expenses associated with acquiring alternative goods and services. You should not presume the presence of any such connection or affiliation. Any trademarks or names displayed on this webService are the property of their respective trademark owners. When a trademark or brand name is mentioned, it is solely for the purpose of describing or identifying the products and services and does not imply that Best Dating App Ever endorses or is linked to these products or services in any way.

These terms and conditions, along with the transactions they cover, will be subject to and governed by the laws of Florida. Any legal or equitable action arising from or related to these Terms will exclusively be filed in the courts situated in Florida.
